This Privacy Policy explains how we process the personal data of users of the neoreklamy.pl website and describes the rules governing the use of cookies and similar technologies.

2. What data may we process?

Depending on how you use the Website, we may process:

  • data provided in the contact form, in particular your name or company name, email address, telephone number and the content of your message;
  • data provided when contacting us by email, telephone or in person;
  • data required to prepare a quotation, enter into and perform a contract and settle payment for a service;
  • technical data, such as your IP address, connection date and time, the address of the requested page, the referring page address, browser and operating system type and information about errors;
  • information stored in cookies, if you consent to their use.

We do not require you to provide special categories of personal data, such as information concerning health, political opinions or religious beliefs. Please do not include such information in the contact form or ordinary correspondence.

3. Purposes and legal bases of processing

Handling enquiries and preparing quotations

We process data provided through the contact form or during correspondence in order to respond to your enquiry, prepare a quotation and take steps at your request prior to entering into a contract. The legal basis is Article 6(1)(b) GDPR. If you contact us as an employee or representative of another entity, the legal basis is also our legitimate interest in conducting business correspondence and handling enquiries — Article 6(1)(f) GDPR.

Entering into and performing a contract

We process customer data in order to prepare, enter into and perform a contract, including agreeing the design, production, delivery, installation and after-sales service. The legal basis is Article 6(1)(b) GDPR.

Settlements and legal obligations

We process data contained in accounting and settlement documents in order to fulfil obligations arising from tax and accounting legislation. The legal basis is Article 6(1)(c) GDPR.

Website security and the establishment, exercise or defence of legal claims

We may process technical data and information related to enquiries and contracts in order to ensure the security of the Website, prevent abuse, perform diagnostics and establish, exercise or defend legal claims. The legal basis is our legitimate interest — Article 6(1)(f) GDPR.

Website analytics

If you give your consent, we may use analytics tools to measure traffic on the Website, understand how visitors use it and improve its content. The legal basis for processing is consent — Article 6(1)(a) GDPR. Consent is voluntary and may be withdrawn at any time.

We do not make decisions concerning users that produce legal effects or similarly significantly affect them solely on the basis of automated processing. We do not carry out profiling for behavioural advertising purposes.

4. Contact form and correspondence

Providing data in the contact form is voluntary, but failure to provide information marked as required may make it impossible to submit the form or receive a response. Data submitted through the form is not published on the Website. The message is sent to the Controller and may be stored in an email inbox and in systems used to manage correspondence and provide services.

We do not use data provided in the contact form to send newsletters, nor do we automatically add users to marketing databases.

5. Recipients of personal data

Data may be disclosed only to the extent necessary for the relevant purpose. Recipients of personal data may include:

  • Globtel Internet Szymon Hersztek, ul. Matecznikowa 2/1, 80-126 Gdańsk, Poland — the provider of hosting, server infrastructure and email services;
  • entities providing website maintenance, IT support and security services;
  • our accounting office, legal advisers and other professional advisers, where access to data is necessary for them to provide their services;
  • subcontractors, suppliers and transport companies involved in fulfilling an order — only to the extent necessary to provide the service;
  • Google Ireland Limited — solely in connection with Google Analytics and only after consent to analytics cookies has been given;
  • authorised public authorities, where disclosure is required by law.

We do not sell personal data or otherwise make users’ personal data available to other entities for a fee.

6. Transfers of data outside the European Economic Area

In connection with the use of Google services, analytics data may also be processed outside the European Economic Area, in particular in the United States. Google uses legal mechanisms provided for by data protection legislation, including adequacy decisions, the EU–US Data Privacy Framework and standard contractual clauses, as applicable.

7. How long do we retain data?

  • As a general rule, we retain data relating to enquiries that did not result in a contract for up to 12 months after the correspondence has ended.
  • We retain data related to the performance of a contract for the duration of the contract and subsequently until the expiry of the limitation periods for potential claims.
  • We retain accounting and tax documents for the period required by law, generally for five years calculated from the end of the relevant tax year.
  • Technical logs may be retained for up to 12 months, unless longer retention is necessary to investigate an incident or defend against legal claims.
  • We retain user and event data in Google Analytics for a maximum of 14 months. The duration of individual cookies may differ and is described below.
  • We retain data processed on the basis of consent until consent is withdrawn or until the data is no longer required for the purpose for which consent was given. We may retain information concerning the giving or withdrawal of consent for as long as necessary to demonstrate compliance with the law.

8. Rights of data subjects

Subject to the conditions set out in the GDPR, you have the right to:

  • access your data and receive a copy of it;
  • rectify inaccurate data or complete incomplete data;
  • erase your data where the conditions provided for by law are met;
  • restrict processing;
  • data portability where data is processed by automated means on the basis of consent or a contract;
  • object to processing based on the Controller’s legitimate interests;
  • withdraw consent at any time, without affecting the lawfulness of processing carried out before its withdrawal.

You may submit your request to biuro@neoreklamy.pl. If we have reasonable doubts concerning the identity of the person submitting a request, we may ask for additional information necessary to verify their identity.

You also have the right to lodge a complaint with the President of the Personal Data Protection Office in Poland. Current contact details for the supervisory authority are available at uodo.gov.pl.

9. Cookies

Cookies are small files stored on a user’s device while they browse a website. The Website may use the following categories of cookies:

  • essential cookies — enable the Website to operate correctly and securely and remember privacy settings; their use does not require consent;
  • analytics cookies — help us measure traffic and understand how the Website is used; they are activated only after consent has been given.

Cookies may be session cookies, in which case they are deleted when the browser is closed, or persistent cookies, which remain on the device for the period specified in their parameters or until they are deleted.

You can manage your cookie consent using the settings available in the cookie banner. Consent may be withdrawn at any time as easily as it was given. You may also block or delete cookies in your browser settings. Restricting essential cookies may affect the correct operation of certain parts of the Website.

10. Google Analytics

The Website may use Google Analytics 4, an analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The tool is activated only after consent to analytics cookies has been given.

Google Analytics may collect information about the device and the way in which the Website is used, including approximate location, device type, browser, pages visited, traffic source and interaction time. This information is used to compile statistics and improve the Website.

Google Analytics may use cookies including _ga and _ga_<identifier>, which generally have a maximum duration of up to two years. Withdrawing consent prevents analytics from being activated in the future, while cookies set previously may be deleted using the consent management mechanism or browser settings.

11. Links to external websites

The Website contains links to external websites, in particular to the Neo Reklamy Facebook profile. A standard link does not itself embed Facebook content on the Website. When you click a link, you leave our Website and any subsequent processing of your data is governed by the rules of the service you visit.

We apply technical and organisational measures appropriate to the nature of the data processed and the associated risks, including transmission encryption using an SSL certificate, access restrictions, software updates and backups. Access to data is granted only to persons and entities that require it in order to perform their assigned tasks.

13. Changes to this Privacy Policy

This Privacy Policy may be updated, in particular following changes in legislation, the operation of the Website or the tools used. The current version is always published on this page together with the date of the latest update.
